ARAQUE v. VANTAGE MARKETING GROUP, LLC and TERMINIX INTERNATIONAL, LLC

On August 22, 2019, a class action lawsuit was filed on behalf of Dillon L. Araque against Defendants Vantage Marketing Group, LLC and Terminix International, Inc. in the San Mateo County Superior Court, Case No. 19CIV04886.  The complaint alleged seven causes of action for: (1) failure to provide meal periods; (2) failure to provide rest breaks; (3) failure to pay hourly wages; (4) failure to indemnify; (5) failure to provide accurate written wage statements; (6) failure to timely pay all final wages; and (7) unfair competition.  On October 22, 2019, Plaintiff filed a First Amended Complaint adding a cause of action under the Private Attorneys General Act of 2004 (Lab. Code sections 2698, et seq.).  Defendant Vantage Marketing Group, LLC subsequently removed the action to the Northern District of California, Case No. 19-cv-07021.  The case was subsequently assigned to the Hon. William H. Alsup.

The parties subsequently filed a Joint Stipulation to Dismiss the Action In Its Entirety. (Dkt 19.)  On February 6, 2020, after the parties appeared before the Court at a regularly scheduled Case Management Conference, the Court granted the Joint Stipulation. (Dkt 24.)
On February 10, 2020, Plaintiff re-filed the action in the Los Angeles County Superior Court, Case No. 20STCV05246.
