In California, employees who are considered to be non-exempt and generally paid on an hourly basis, are entitled to be paid overtime if they work more than 8 hours in the same workday; and double time if they work more than 12 hours in the same workday. In addition, the overtime rate must be calculated based on the regular rate of pay which takes into consideration all other forms of compensation paid to the employee during the same workweek (including but not limited to commissions, non-discretionary bonuses, piece rates). Some employers attempt to evade the overtime laws by “permitting” an employee to take another day “off” or by paying the overtime hours on another day when the employee did not work. Such practices are illegal and do not comply with California or federal overtime laws.
